1. Agreement to Terms
By accessing or using Harris Reserve Digital Services ("Harris Reserve," "we," "us," or "our") — including our website at harrisreserve.com, our missed call text-back system, or any related services — you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Services
Harris Reserve provides an automated missed call text-back system for local businesses. When a call to a client's business goes unanswered, our system automatically sends an SMS message to the caller on behalf of the business within approximately 60 seconds. Services include:
- Automated SMS text-back triggered by missed inbound calls
- Booking link integration for caller scheduling
- Monthly performance and ROI reporting
- Urgent call alert notifications (Premium plan)
- Monthly check-in calls (Premium plan)
3. SMS Messaging & Consent
Harris Reserve sends automated SMS messages to individuals who call the Harris Reserve demo line at (469) 452-7134. By placing an inbound call to the demo number, the caller consents to receive an automated SMS response demonstrating the Missed Call Recovery System.
End-users opt in by visiting harrisreserve.com and viewing the call-to-action in the Contact section, which states: "Try the demo: Call (469) 452-7134 and don't answer it. Within 60 seconds you'll get a text back — that's exactly what your missed callers experience. By calling the demo number you consent to receive up to 2 automated SMS messages from Harris Reserve demonstrating our Missed Call Recovery System. Message and data rates may apply. Carriers are not liable for any delayed or undelivered messages.
4. Fees and Payment
Our current pricing is as follows:
- Setup deposit: $75 (non-refundable once configuration has begun)
- Final payment: $75 due after your first free month of service
- Standard plan: $147/month after the first free month
- Premium plan: $197/month after the first free month
All payments are processed securely through Stripe. Harris Reserve reserves the right to update pricing with at least 30 days written notice to active clients.
5. Free Trial
New clients receive their first month of service at no charge. The free trial begins once your system is fully configured and live. No automated billing occurs during the trial period.
6. Cancellation Policy
You may cancel your service at any time by providing 30 days written notice via email to landon@harrisreserve.com. Service continues through the end of the notice period. The setup deposit is non-refundable if system configuration has already begun. No other cancellation fees apply.
7. Client Responsibilities
As a Harris Reserve client, you agree to:
- Provide accurate business information for configuration
- Configure call forwarding as instructed by Harris Reserve
- Use the service only for lawful business communication purposes
- Not use the service to send spam, unsolicited messages, or content that violates applicable laws
- Comply with all applicable federal and state laws, including the Telephone Consumer Protection Act (TCPA)
8. Intellectual Property
All content on harrisreserve.com — including text, graphics, logos, and software — is the property of Harris Reserve Digital Services and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
9. Limitation of Liability
Harris Reserve is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to lost revenue, missed leads, or SMS delivery failures caused by carrier filters or network issues. Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the event giving rise to the claim.
10. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee 100% SMS delivery rates, as carrier filtering and network conditions are outside our control. We do not warrant that the service will be uninterrupted or error-free.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
12. Changes to Terms
We may update these Terms from time to time. We will notify active clients of material changes by email. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

- Every message includes opt-out instructions. Recipients may reply STOP at any time to stop receiving messages.
- Recipients may reply HELP for assistance information.
- Opt-out requests are honored immediately and permanently.
- We do not sell, rent, or share SMS opt-in data or phone numbers with third parties for marketing purposes.
- Message frequency will vary. Standard message and data rates may apply.
5. Data Sharing
We do not sell your personal information. We may share information only in these limited circumstances:
- Service providers: We use third-party platforms (such as SMS carriers and Stripe for payments) that process data on our behalf under confidentiality agreements.
- Client businesses: Caller replies and interaction data are shared with the client business that uses our service, since those conversations belong to that business relationship.

6. Data Retention
We retain client account information for as long as the account is active and for a reasonable period afterward for recordkeeping purposes. SMS conversation logs are retained for up to 12 months. You may request deletion of your data at any time by contacting us at landon@harrisreserve.com.

We take reasonable technical and organizational measures to protect your information from unauthorized access, loss, or misuse. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
